Naturalisation deferred or refused: what remedy is available?

Read the decision carefully before taking action

An unfavourable naturalisation decision can take several forms. Your strategy depends on its legal classification and grounds. Do not rely on the word “refusal” used in conversation: check the exact heading, the notification date and the available remedies stated in the decision.

Inadmissibility

A finding of inadmissibility means that a legal condition for naturalisation has not been met: residence, lawful immigration status, language proficiency or another requirement. An appeal must demonstrate that the condition was satisfied on the relevant date or that the authorities made an error in their legal assessment.

Resubmitting the same application without correcting the problem often leads to the same outcome.

Deferral

A deferral postpones favourable consideration for a set period or until a condition has been met. It may be based on employment integration that is deemed too recent, unstable income, an outstanding debt or circumstances that need to be assessed over a longer period.

You can wait for the period to end and strengthen your application, or challenge the decision if the reason is based on an error or a disproportionate assessment. The decision states the deferral period.

Rejection

Even when the admissibility requirements are met, naturalisation remains a decision for the French State. Nevertheless, a rejection must give reasons and may be challenged when it is based on inaccurate facts, an error of law or an assessment that is manifestly open to challenge.

The two-month time limit

For an unfavourable decision, you generally have two months from notification to lodge the prescribed administrative appeal. Where this option applies, the appeal is submitted online using the form available in your personal account. For a paper application, follow the stated address and procedure exactly.

Keep proof of the notification date and the acknowledgement of receipt for the appeal. Without them, it becomes difficult to establish that you met the deadline.

Urgent

An unfavourable decision triggers a short deadline

Have the grounds, evidence and notification date reviewed before submitting an incomplete appeal.

Appeal to the Minister, then the Nantes Administrative Court

An administrative appeal to the Minister responsible for naturalisation must, in principle, precede court proceedings. If the Minister gives a negative response, or does not respond within four months of receiving the appeal, the matter can be brought before the Nantes Administrative Court within the stated time limit, generally two months.

Do not apply directly to your local administrative court without checking jurisdiction. Litigation concerning naturalisation decisions is centralised in Nantes.

Building an effective appeal

A good appeal responds to the reasoning in the decision:

  1. set out the facts and procedure in chronological order;
  2. quote each ground exactly;
  3. explain the alleged error;
  4. match each argument with a supporting document;
  5. clearly request that the application be reconsidered.

Adding dozens of documents without explanation is not enough. Conversely, a lengthy account without verifiable evidence remains weak.

Appeal or a new application?

A new application makes sense when the situation has genuinely changed: the deferral period has ended, employment has stabilised, a debt has been settled or a condition is now met. An appeal is more appropriate if the decision was already open to challenge in light of the information available.

The two approaches have neither the same objective nor the same timetable. Before choosing, assess the strength of the existing evidence and the time needed to improve the situation.

Documents to keep immediately

  • the full decision and envelope or electronic notification;
  • proof of the date it was accessed;
  • a copy of the initial application;
  • requests for additional information and your replies;
  • the receipt and ministerial reference number;
  • new evidence since the application was submitted.
